UP lawyer slams VP Leni Robredo suggesting realignment of DepED funds: "Diba, Madam, abugada ka at dati pa ngang Kongresista?!"

 


A few days ago Vice President Maria Leonor “Leni” Robredo floated the suggestion that the Department of Education (DepEd) realign its P30.7 billion of its 2020 budget for distance learning requirements.

She wrote a letter to Department of Education Secretary Leonor Briones, urging the latter use the P29.5-billion budget for rehabilitation of school buildings for blended learning requirements since there will be no need for new classrooms.

“This amount can be used to procure the needed gadgets and equipment for distance learning, as well as address the health concerns of educators,” Robredo said.

And this was slammed by University of the Philippines lawyer Atty. Nick Nangit, in his Facebook post he reminded the Vice President that funds allocated for the rehabilitation of public schools are based on the General Appropriations Act, which cannot reaily be changed with an enabling law.

“Alam nyo po ang paglalaan ng pondo para sa rehabilitasyon ng mga pampublikong paaralan ay nakasaad na sa national budget na makikita sa GAA o General Appropriations Act.

Batas yan, at may mga line items para diyan.

May mga probisyon din tayo sa Revised Penal Code na nagsasabing bawal gamitin ang mga nakalaan na paggagastusan sa mga bagay na hindi naman para doon. Maaaring malversation yan ng pondo.

Kung kinakailangang ibaling sa iba ang pondo, dapat gumawa muna ng bagong batas, at hindi yung kung anu-ano na lang ang maisip e tama agad, kahit ano pang hangarin mo! “

The UP lawyer also chided the Vice President, that being a lawyer and a former legislator she should know these rules with respect to the GAA.

E kasi nga, iniiwasan ng batas ang pagpapaikut-ikot ng kaperahan na maaaring maging sanhi pa ng korapsyon. Kung hindi, ano pa ang saysay ng paggawa ng national budget kung pwede naman palang gamitin ang pondo o malilikom na pera sa kahit ano na lang? Nasa Saligang Batas din natin yan!


E kasi rin yan ang sistema ng ating bansa. May mga batas na dapat sundin, kaya nga may parusang kulong pag gumawa ng krimeng malversation.


At saka ang rehabilitasyon ng mga gusali ay kinakailangang gawin, dahil pangmatagalan yan at, ayon din sa mga arkitekto at inhinyero, regular itong gagawin para hindi lalong masira ang mga gusali kapag ito ay pinabayaan.


Ang mga gadgets at distance learning equipment ay pansamantalang solusyon lamang, habang wala pang permanenteng solusyong magpapatigil na sa pagkalat ng veerus. May option din na modular instruction, atbp.


Ngayon, dapat alam mo yan!
