The Supreme Court
(SC) has been quoted a few weeks back that it will welcome all parties who
would to question the Anti-Terrorism Act of 2020.
And it seems the
petitions questioning the law’s constitutionality will still be increasing in
the coming more days, as a youth group mostly members of the Sangguniang
Kabataan(SK) filed a petition asking the Supreme Court (SC) to declare as “null
and void” the Anti-Terrorism Law which they likened to Adolf Hitler’s Reichstag
Fire Decree that suppressed key civil liberties of Germans and led to the
creation of Nazi Germany.
“Like Germany did in
1933 when it enacted the Reichstag Fire Decree, this country now stands on
perilous grounds,” read the petition.

This group explains
that the German decree was issued following the burning of the Reichstag or the
parliament building in Berlin which, though the origin of the fire remains
unknown, Hitler cited as evidence of communist plot to overthrow the government.
“The decree was
sweeping in terms of the rights it curtailed -due process, free expression,
freedom of the press, the right of assembly and association, privacy of communication,
and the protection from warrantless arrests and searches, and other
restrictions of liberty – all done to prevent acts of ‘terrorism’ across
Germany,” they said.
The petitioners
likens the Anti-Terrorism Act to the “the
Reichstag Fire Decree.”
“The enforcement of
RA 11479 necessarily involves a direct and unequivocal violation of constitutional
safeguards. So long as it is in effect, this law maintains an atmosphere of
fear – the proverbial ‘chilling effect’ – that deters the free and full exercise
of fundamental rights. Thus, the law poses a danger not just for collective and
individual rights, but for democracy as a whole,” they stated.
