Not so fast!
The Municipal Trial
Court Judge Liezela Aquiatan has handed detained senator Leila De Lima a big NO
in her request via motion to be allowed to participate in the Senate sessions
and committee hearings via teleconferencing.
“Allowing De Lima to
participate in the Senate sessions, committee hearings, and meetings via
teleconferencing from within her place of detention is no different from
allowing her to attend there physically,” read the order of the magistrate.

“Allowing her to do so today would be tantamount to allowing her
to participate even after state of public health emergency,” she added.
Judge Aquiatan took note of a judicial precedence promulgated
by the Supreme Court where it ruled that detained legislators are not allowed
to perform their legislative duties as such.
With the said SC ruling, De Lima cannot cite
the amended Senate Rules in response to the pandemic which allowed
senators to hold teleconferencing in cases when “there is force majeure or
occurrence of an emergency.”
“De Lima is prevented to attend the committee meeting or
hearings due to her detention,” the judge said.
“Detention is not a force majeure,” she stressed.
De Lima is currently
facing three illegal drug charges and have been detained in the Philippine
National Police Detention Center in Quezon city since 2017.
