The rights of the lesbian,
gay, transgender, bisexual, and queer sector (LGBTQ++ sector) of the Philippine Society got a big
setback.
The Highest Court of the land just handed down
the decision dismissing the petition that sought to allow same-sex marriage in
the Philippines.
Under the ponencia of Associate Justice Marvic
Leonen, the Supreme Court (SC) dismissed the same-sex
petition on account of lack of standing of petitioner Jesus Falcis, violation
of principle of hierarchy of courts and failing to raise actual, justiciable
controversy.

The SC was also holding Falcis and his counsels
in indirect contempt for forgetting "bare rudiments of court procedure and
decorum or worse, to purport to know them but really only to exploit them by
way of propaganda."
In 2015,
Falcis himself filed the petition, wherein he described himself in the pleading
as "an open and self-identified homosexual."
Falcis asked the high court to declare as unconstitutional a
portion of the Family Code of the Philippines which "define and limit
marriage as between man and woman."
A setback for LGBT++ rights
The House of Representatives recently passed in
third reading the Sexual Orientation and Gender Identity and
Expression “SOGIE” Equality bill and it is
now pending in the Senate.
Principal
author of the bill in the Senate is opposition and leftist senator Rissa
Hontiveros, who also happens to be the Chairperson
for the Senate Committee on Women, Children, Family
Relations and Gender Equality.
Hontiveros,
stresses the importance of a law that will protect people from sexual and
gender-based discrimination and inequality, and laments that it is long overdue.
