Duterte : Trillanes' amnesty, one of Noynoy Aquino's 'glaring mistakes'



The one on one interview conducted by Chief Presidential Legal Counsel Salvador Panelo with President Rodrigo Roa Duterte was one that was really for setting the records straight with respect to the plans, policies and the true status of issues being thrown by the opposition to his administration.

One of the highlight is the counter attack done by the President against opposition Senator Antonio Trillanes IV.

When asked by Panelo about the amnesty given by former president Benigno Aquino III to the Oakwood mutineers, Duterte said that this was one of the glaring mistakes of the previous administration.

Pagka mali is mali. Hindi mo talaga ma-correct ‘yan (If it is wrong, it’s wrong. You cannot correct that) and one of the glaring mistakes of the Aquino administration was to extend an amnesty,” Duterte said in MalacaƱang palace.

The President explains that the procedure in the issuance of Proclamation No. 75 by Aquino in 2010 was “totally wrong in the sense that he just issued the proclamation” without giving particular names.

“It was a motherhood statement to cover the individual and any of the acts of the mutineers,” he said.

He also blames Aquino for the fact the he designated then Defense Secretary Voltaire Gazmin to investigate and sign the amnesty itself.

“You know, it is possible to do that. Why? Because an act of pardon or amnesty is an act of State. It cannot be delegated to anybody but to the person or the President himself,” said Duterte.

The 1987 Constitution exclusively vest the President the power of granting of amnesty as well as to declare martial law, suspend the privilege of the writ of habeas corpus and to call Congress to a special session.

“An act of amnesty is always an act of State which cannot be done by a mere Cabinet member. Especially if that Cabinet member was the one or was the one of those who investigated and made the recommendation and approved the recommendation himself,” he said.

The President said that if the Supreme Court would not see it the way he sees it, he would accept that new jurisprudence.

Last month (August 31) the President signed Proclamation 572 to which it declared the grant of amnesty to Trillanes void ab inition (from the beginning) “because he did not comply with the minimum requirements to qualify under the Amnesty Proclamation”.

Duterte ( Calida) claims that Trillanes did not personally fill up and file the official amnesty application form and has not expressly admitted his guilt for the crimes he committed during the Oakwood Mutiny in 2003 and the Manila Peninsula Siege in 2007.

Duterte claims Gazmin signed the amnesty for Trillanes because he wanted to protect the former president.

“He was actually protecting Aquino. And there are – all the time sa lahat ng ano, they were protecting Aquino,” Duterte said.

It is totally assurpation of authority and i dont think they really understand it meant what the constitution expresses.just like the irregularities happen to the mamasapano that causes loss of lives of the saf44.wherein the then ombudsman morales charged pnoy of usurpation of authority in which the law says the president has all the power and authority hence accountable to all implementations of the law..the dengvaxia that causes loss of lives of the children.the manipulation of funds for yolanda and many govt projects like housing intended for the AFP personnels and many more.
    They really doesnt understand their responsibility as mandated by the constitution. Just like this amnesty grantes to trillianes,how the hell DND secretary Gazmin does everything to Pnoy without being charge of usurpation?.This is a blutant violation of the constitution.
    They are the ones making a law but it seems like they doesnt understand really what is it for..
    As the police say "Ignonce of the law is ...hindi ko alam".
