Duterte slams Kiko Pangilnan's authored law that exempts minors fromcriminal liability




President Rodrigo Roa Duterte slams opposition Senator Francis “Kiko” Pangilinan.

The President said that it is unlikely that the Liberal party stalwart can win another elective post after he authored the controversial and flawed juvenile justice law in the country.

Duterte lashed out the “pontifical” Pangilinan for the law that let’s the young criminal offenders get away with their offenses.

“Ito naman si pontifical Pangilinan, akala mo walang kasalanan kung magsalita. Siya pa ‘yung presidente ng Liberal (party). Tignan mo, pati siya hindi manalo ‘yan [This pontifical Pangilinan thinks he has no liability when he talks. He’s the president of Liberal. Just look, he will not win],” Duterte said in MalacaƱang.

“The entire Philippines for the last two decades, right after the — itong Pangilinan law, nagkalat. Kasi alam ninyo, pagka-minor, he goes out. ‘Pag sinabi niya, ‘I am just 14 years old,’ he goes out. Walang seremonya,” he added.

The President criticized his friend mainly because the authored law exempts minors below 15 years old from criminal liability regardless of the gravity of the offense. Duterte was referring to Republic Act 9344 of the Juvenile Justice and Welfare Act of 2006.

Prior to the Pangilinan authored law, a child offender aged nine or under who commit an offense were exempted from criminal liability and released to the custody of parents.

“Itinaas husto ni Pangilinan. Eh pa-pretty boy-pretty boy para to keep abreast with the changing times,” he said.

The President said Sen. Pangilinan, did not bother to research that the United States of America, where he copied the juvenile law, has “reverted back to treating youthful offenders tried as adult offenders for grave and less grave offenses.”

“If you rape, you steal, kill, after robbing, killing, raping, you should be treated as an adult offender,” he said.

He further explains that the Pangilinan measure also missed a key provision of the US juvenile law that requires young criminals to go to a correctional facility to undergo rehabilitation.

At present, under the Pangilinan law, young offenders go scot-free. These minors who will eventually be adults in the society have lost “the sense of accountability.”

He further explains that he had recently have had meetings with some senators who stated “they will try to repeal the law.”

There is a current proposal to amend the law to bring down the age of criminality liability to 13 years old. Criminal syndicates were allegedly abusing the loophole in the Pangilinan law, were minors can commit crimes. The proponent of the proposal is Senate President Vicente Sotto III.

  1. AS FOR ME I'VE SEEN OUR NEIGHBORS HERE AT A.H. LACSON ST. AS YOUNG AS 10 YEARS OLD STEALING JACKS FROM FREIGHT TRUCKS WHO WERE CAUGHT IN TRAFFIC JAM .AFTER THE HELPER OF TRUCK CONFRONTED THEM THEY GANG UP AND BEAT UP THE POOR GUY WITH GI PIPES . WELL I BELIEVED THAT AS YOUNG AS 10 IS MATURED ENOUGHT TO DISCERN FROM WHAT IS RIGHT FROM WHAT IS WRONG IF THEY KNEW HOW TO ORGANIZED AS A GROUP TO COMMITS CRIME.
