Antonio Trillanes could not find copy of his amnesty application form - admits his lawyer

Senator Antonio Trillanes IV is in a much deeper hole.

He cannot find his copy of the amnesty application form he filed, his counsel Atty. Reynalso Robles admitted before the Makati City Regional Trial Court Branch 150.

Judge Elmo Alameda asked Robles for Trillane’s copy of the application form as proof that he has complied with the basic requirements for an amnesty.

“The court needs the actual application,” Judge Alameda said.

“He cannot find his copy,” Robles admitted.

“The court is not after secondary evidence,” Judge Alameda responded.

The Rebellion case against Trillanes and other Magdalo mutineers for the 2007 Manila Peninsula hotel seige.

In an ambush interview, Robles admitted that they are still in the process of looking for the application form.

During the hearing, what was presented as evidence was  avideo footage of the actual filing of application form before a certain Col. Josefa Berbigal

Judge Alameda, called out the video as not authenticated.

Robles, promised the court they will submit other proofs to authenticate their evidence.

He also presented Trillanes’ amnesty certificate, pictures of the Senator holding a copy of his application form published in the Philippine Daily Inquirer, and the memorandum to the Department of National Defense (DND)  Ad Hoc Committee.

An affidavit from Berbigal will eventually be submitted, this will attest that he received the appl;ication form of Trillanes.

Alameda also asked the prosecution about its proof that Trillanes failed to comply with his amnesty requirements.

This prompted Judge Alameda to ask the DOJ prosecutors: “That is your basis in concluding that court’s dismissal is void?”

The DOJ prosecutors maintains that because of Proclamation No. 75 revoking Trillanes’ amnesty, the court’s dismissal of the rebellion case seven years ago is void.
